Peak is a wellness and fitness tool, not a medical device or emergency service. Its scores, estimates, coaching, meal analysis, cycle guidance, and trends may be incomplete or wrong. Always consult a qualified professional before making a medical decision.
Agreement
By downloading, accessing, or using Peak, you agree to these Terms and the Peak Privacy Policy. If you do not agree, do not use the app. You must be legally able to accept these Terms and meet the minimum age required in your region. Peak is not directed to children under 13.
The Peak service
Peak helps people organize fitness, nutrition, hydration, recovery, sleep, habits, journal entries, cycle context, health measurements, and personal goals. Features can change during development, beta testing, and after release. We may add, revise, pause, or remove features when needed for quality, safety, platform compliance, or product direction.
You receive a personal, limited, nonexclusive, nontransferable, revocable license to use Peak on Apple devices you own or control, subject to the App Store usage rules. Peak and its visual identity, software, copy, and original content remain the property of NexCode or the applicable licensor.
Health and safety limits
- Peak does not diagnose, monitor, cure, mitigate, treat, or prevent disease.
- Do not disregard professional advice or delay seeking care because of Peak output.
- For an emergency, contact local emergency services. Do not rely on Peak, AI, HealthKit readings, cycle estimates, or WeatherKit for an emergency decision.
- Only use exercises, dietary changes, and wellness suggestions appropriate for you. Stop activity and seek care if you experience concerning symptoms.
- Measurements shown by Peak originate from user entries or compatible data sources; Peak does not claim to measure blood pressure, oxygen, temperature, or other clinical values using the iPhone alone.
Accounts and acceptable use
Peak may require an account through Apple, Google, or another offered method. Keep your device and credentials secure and provide accurate information. You are responsible for activity under your session.
Do not reverse engineer the app except where law expressly permits, bypass subscriptions or security, probe services, upload unlawful or harmful material, misuse another person’s health information, automate abusive requests, or use Peak in a way that violates law or third-party rights. We may limit or terminate access where necessary to protect users, the service, or legal compliance.
Subscriptions and purchases
If Peak Premium is offered, weekly, monthly, and yearly auto-renewing plans may be available. The App Store purchase screen shows the current price, billing period, trial (if any), and region-specific terms before you confirm. Payment is charged through your Apple Account. Subscriptions renew unless canceled under the terms shown by Apple.
Manage or cancel through Settings → your name → Subscriptions. Cancellation stops a future renewal but generally does not retroactively refund the current period. Refund eligibility is determined by Apple and applicable law. “Restore Purchases” asks Apple to restore eligible entitlements. NexCode does not receive your full payment-card information.
AI, nutrition, and third-party information
Peak can provide on-device coaching and optional OpenAI-powered features. AI output is probabilistic, can be inaccurate, and is not professional medical or dietary advice. Review every meal item, serving, calorie, and macro estimate before saving or acting on it. Barcode information from Open Food Facts is community-provided and may also be incomplete.
You must have the right to submit any text or image you choose for analysis. Do not submit another person’s private health information or illegal content. Use of a user-supplied OpenAI account or key is also subject to OpenAI’s applicable terms.
Apple Health, iCloud, and permissions
Peak’s ability to read or write Apple Health data depends on the permissions you grant. You can change permissions at any time, and features may be limited if access is unavailable. iCloud synchronization depends on your Apple Account, storage, network, CloudKit availability, and device settings. You are responsible for maintaining any backups or exports important to you.
Weather notice
Your use of real-time weather guidance is at your sole risk. Weather data may not be accurate. Apple Weather data can vary from actual conditions because of signal issues, source limitations, geopolitical events, and other factors. Peak weather is contextual information, not an emergency-alert or life-saving service.
Disclaimers and responsibility
To the fullest extent permitted by law, Peak is provided “as is” and “as available,” without warranties that it will be uninterrupted, error-free, secure, or suitable for a particular health outcome. NexCode is responsible for Peak—not Apple, Google, OpenAI, Open Food Facts, or other platform providers.
To the fullest extent permitted by law, NexCode will not be liable for indirect, incidental, special, consequential, or punitive loss arising from use of or inability to use Peak. Nothing in these Terms excludes rights or liabilities that cannot legally be excluded, including applicable consumer protections.
Changes, termination, and contact
We may update these Terms as Peak evolves. Continued use after an update means you accept the revised Terms where permitted by law. You can stop using Peak at any time and can initiate account deletion inside the app.
Questions about these Terms can be sent through Peak Support. Apple is a third-party beneficiary of the app license terms where required by its minimum terms.
